Below are general steps for handling your Petition drafting process. We can personalize our process to seamlessly integrate with the flow of your daily operations, unless, of course, your current process needs a bit tweaking in order to maximize your firms' profits.
We highly recommend using our FREE Client Intake Forms and Client Checklist.
Our Client Intake Forms are designed to flag any potential problems as well as assist in the production of a well-detailed petition as required by the Bankruptcy law change in 2005.
The Client Intake Forms can be personalized with your law firm's information at no additional charge.
Attorney Responsibilities:
- Attorneys are now required to have their own license copy of their preferred bankruptcy software before we begin drafting . Though, we highly recommend using Best Case© or EZ-filing©, we can use any bankruptcy software you have in your office as long as you provide us with the license.
While Best Case© is the most expensive, it is the most powerful and has the best Chapter 13 plan calculator, among other features, for quicker petition drafting. We have found that other software requires more time to draft petitions, which may affect our fees. - Review, Sign and Return Service Agreement to PAVBS.com.
- Ensure that your client(s) have completed the mandatory Credit Counseling requirement, or at least have one scheduled as soon as possible.
- Give your Client a copy of the Client Intake Forms together with the Client Checklist. The Client Checklist makes it easier for your Client when gathering required documents. We can also personalized the Client Intake Form with your law firm's contact information at no additional charge.
- When the completed Client Intake Forms are returned to the Attorney, Attorney will review the forms to ensure ALL information has been properly recorded and all pages returned, whether information was applicable or not.
- To get started, provide PAVBS with the following documents:
- Completed Client Intake Forms (all pages returned)
- Credit Counseling Certificates for each Debtor
- Most recent pay stubs and/or other income advices for the past 6-months
- Past 2 years of filed Tax Returns

PAVBS.com Responsibilities:
Once PAVBS.com has received all necessary documentation, we will:
- Input of all data from Client Intake Forms and provided documentation into bankruptcy software.
- Compile a list of questions for client(s) to obtain the additional detailed information not provided on the Client Intake Forms .
- Note: If permitted by attorney, PAVBS.com will contact the client(s) and obtain the missing information at no additional cost. If client(s) are contacted, we will represent ourselves as working under the direction of the Attorney. We are trained in procedures to ensure non-violation of UPL (unauthorized practice of law). We find that this is the best and fasted way to complete an accurate petition.
- Provide a Summary Sheet to attorney detailing about the bankruptcy case and alerting attorney to any possible problems such as unexempt equity or potential fraud that will protect attorney from court fines and/or embarrassment at the 341 Meeting of Creditors.
- Research and obtain printout of Market values of vehicles, motorcycles, boats, RV's, manufactured homes from Nada Guide®.
- Search for criminal records and law suits in client(s) name within county or residence in any online database Attorney has available.
- Provide a draft of bankruptcy petition to Attorney for review.
- Make changes to the petition as per Attorney’s instructions, if necessary.
- Return completed bankruptcy petition for electronic filing
- Note: Electronic filing of bankruptcy petition is available at an additional cost.
- Email a copy of completed bankruptcy petition to client(s), if requested.
